Technically this is legal through a loophole, isn't it?

I love technicalities inside law. =D

Here's how this site works... the people who own it is the host. The soundtracks and animes get uploaded by the members who have either bought the soundtracks and animes or have downloaded them from somewhere else. The site doesn't ask people to pay to download the soundtracks or anime. You can download all of the soundtracks and anime for free. The site does have an option for you to contribute money to the server cost. The site also has put up disclaimers when you go to download soundtracks or animes. So they are technically not doing anything wrong. Just hosting a file site something like rapidshare or megauploads. Besides, when a copyright holder contacts them, they quickly comply to their wishes and remove the soundtracks.

Wrong. Different media has different licenses - all up to the fantasy of the creator. Electrons do not have such thing as license in nature. But even if we do not concentrate on that, its clearly stated in the agreement on this site (which person must accept, to get the file) - a person who downloads MUST be in possession of rights to use the title in order to use the file (which is achieved usually with purchase of the retail copy, but it can vary).

In other words, you may download and use any thing only if you possess the rights to do it.
So its up to YOU, to make sure if you do. And you accept all legal responsibility. Period.

Of course, it is how I understand the model here.

So, everything's legal (if you own it); get back to work! =)

It is definitely NOT legal, otherwise why would they take stuff down at a company's request? Because they don't want to get sued, that's why. These albums cost money, and so by providing them for free, this site is distributing copyrighted content illegally. It's not the same as somewhere like Rapidshare because this site actively promotes and hosts the files, whereas stuff gets deleted from RS all the time. All the same, it makes no difference to them because the companies that own the music don't usually care enough to do anything about it, since videogame OSTs don't make up a very large portion of their revenue.
And I don't really care either way, I'd dl stuff anyway.

its not illegal, and if they are asked to take down content well they HAVE to take it down... if someone doesnt ask them that means they dont care ... and thats not illegal
