I'll venture a guess...
Square has gotten such a reputation for not only its games, but its soundtracks as well that they'll release 'em even if they're not the best (I'm looking at
you Parasite Eve 2) and I'm sure they have an agreement with the respected artists who composed the music. I'm not even sure that a portion of the soundtrack sales get back to the original composer.
Nintendo, who I'm assuming is much more stringent with their programmers, composers, and pretty much everyone, probably owns the entire rights to the soundtracks published by the in-house composers and have just sat on this missed opportunity. There's no real excuse for SSBM because it was developed by HAL, a 2nd-party company to Nintendo. They should be able to publish what they want, although I don't think they really have the resources to do so.
